Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and goCubify LLC, a Wyoming limited liability company. By accessing or using our mobile application, website at gocubify.com, or any related services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy.

Description of Services

goCubify provides a technology platform enabling users to:

• Scan their home using AI-powered image recognition to create an itemized moving inventory
• Receive instant binding moving estimates based on inventory volume and distance
• Select which items to move or leave behind with real-time pricing updates
• Receive AI-powered cost comparisons between moving cost and replacement cost
• Book moving services by paying a deposit through the app
• Be matched with FMCSA-verified moving carriers

goCubify operates as a licensed moving broker. We do not perform moving services directly.

Eligibility

To use our Services you must be at least 18 years of age, a legal U.S. resident, have legal authority to enter binding contracts, and not be barred from receiving services under applicable law.

Your Account

4.1 Account Creation

You agree to provide accurate, current, and complete information at registration and keep it updated.

4.2 Account Security

You are responsible for all activity under your account. Notify us immediately of any unauthorized access.

4.3 Termination

goCubify may suspend or terminate your account at any time for violation of these Terms or fraudulent activity.

Moving Broker Relationship

As a moving broker, goCubify:

• Arranges transportation by verified third-party carriers
• Collects your deposit and remits 85% of the total move cost to the assigned carrier
• Retains 15% of the total move cost as a brokerage commission
• Does not employ the drivers or movers who handle your belongings
• Does not operate trucks or moving equipment
• Is not liable for loss, damage, delay, or claims from the physical transportation of your goods

All moving services are subject to the carrier's Bill of Lading, which is the actual contract of carriage between you and the carrier.

Pricing & Quotes

6.1 Binding Estimates

Quotes are binding based on the inventory you confirm. Your price will not change as long as inventory and services remain the same.

6.2 Price Changes

Your quote may change if you add items, request additional services, have extra cubic footage, or require shuttle service, long carry, or additional stair flights on move day.

6.3 Minimum Volume

A minimum cubic footage requirement applies to all long-distance moves. If your inventory falls below the minimum, the minimum volume price applies.

Payments & Deposits

7.1 Deposit

A 30% deposit is required to confirm your booking. This is processed via our secure payment platform and applied toward your total move cost.

7.2 Remaining Balance

The remaining balance is paid to the carrier per the carrier's payment terms on the Bill of Lading.

7.3 Payment Processing

All payments are handled by our secure payment partner. goCubify does not store your full card information.

Cancellations & Refunds

8.1 Full Refund Window

Written cancellation submitted at least 14 business days before your scheduled pickup date qualifies for a full deposit refund.

8.2 Late Cancellations

Cancellations less than 14 business days before pickup are non-refundable. If your pickup date is within 14 business days of booking, your deposit is non-refundable at time of booking.

8.3 How to Cancel

All cancellations must be submitted in writing using the contact form on this page. Verbal cancellations are not accepted.

8.4 Refund Processing

Approved refunds are processed within 5–10 business days. A 10% administrative fee may be deducted.

8.5 Service Credit

If you cancel after the refund window, you may receive a credit toward future goCubify services, valid for 12 months.

AI Scanning & Inventory

9.1 Accuracy

Our AI inventory scanning uses advanced computer vision technology to identify items from photos and videos. AI-generated inventories may not capture every item or may occasionally misidentify items. You are responsible for reviewing and correcting your inventory before booking.

9.2 Your Responsibility

Your binding quote is based on the inventory you confirm. goCubify is not responsible for price changes from items not on your confirmed inventory.

9.3 Photo Consent

By using the scan feature, you confirm you have the right to photograph the property being scanned and grant goCubify a limited license to process your photos to generate your inventory.

9.4 Photo Deletion

Scan photos are automatically deleted 90 days after delivery confirmation. Move records and inventory data are retained separately per our Privacy Policy.

Carrier Responsibility

goCubify verifies carrier USDOT numbers, MC authority, and insurance at approval. However, goCubify is not responsible for loss, damage, delay, or any claim from physical moving services. Claims must be filed directly with the assigned carrier. Standard valuation is $0.60 per pound per article unless Full Value Protection is selected.

Affiliate Links

goCubify participates in an affiliate program. When our AI determines an item may be cheaper to replace than to move, we may display a product link with an affiliate tag. goCubify may earn a commission if you purchase through these links at no additional cost to you. Purchase decisions are entirely your own.

Prohibited Conduct

You agree not to use the Services for any unlawful purpose; provide false or misleading information; attempt unauthorized access to any system; use bots or scrapers; reverse engineer any part of the Services; harass any person; upload illegal content; interfere with Service functionality; or create multiple accounts to circumvent restrictions.

Intellectual Property

All content, features, and functionality — including the goCubify name, logo, app design, source code, pricing algorithms, and written content — are owned by goCubify LLC and protected by U.S. and international intellectual property law. You may not copy, reproduce, or exploit any part of the Services without express written permission.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. goCubify does not warrant uninterrupted or error-free service, complete AI inventory accuracy, or carrier performance to your satisfaction.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOCUBIFY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. GOCUBIFY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO GOCUBIFY IN THE 12 MONTHS PRECEDING THE CLAIM. GOCUBIFY IS NOT LIABLE FOR ANY LOSS OR DAMAGE TO YOUR HOUSEHOLD GOODS — ALL SUCH CLAIMS ARE THE SOLE RESPONSIBILITY OF THE ASSIGNED CARRIER.

Indemnification

You agree to indemnify and hold harmless goCubify LLC, its members, officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services, violation of these Terms, violation of third-party rights, or inaccurate information you provide.

Dispute Resolution

17.1 Informal Resolution

Before any formal dispute, contact goCubify via the form below. We will attempt informal resolution within 30 days.

17.2 Binding Arbitration

Unresolved disputes shall be settled by binding arbitration administered by JAMS in Sheridan, Wyoming, or remotely by agreement.

17.3 Class Action Waiver

YOU AND GOCUBIFY AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A CLASS OR REPRESENTATIVE ACTION.

Governing Law

These Terms are governed by the laws of the State of Wyoming. Non-arbitration disputes shall be resolved in Sheridan County, Wyoming.

Changes to These Terms

We may update these Terms at any time. Material changes will be communicated by posting an updated version with a new effective date, emailing your registered address, and displaying an in-app notification. Continued use after the effective date constitutes acceptance.
